The Raikes Journal will not be afraid to speak out, and we may occasionally ruffle feather, but genuine errors will be corrected immediately once brought to our attention.

By using our site you accept these terms.

By using our site you are confirming you accept these terms of use and agree to comply with them. If that is not the case, then please do not use the website.

From time to time we may change these terms and conditions and update and change the website to better meet our needs and our customers’ needs and we may suspend or withdraw the site at any point for business or operational reasons. We will always try to give you reasonable notice before doing so.  

You are responsible for ensuring that anyone who accesses this site through your internet connection is also aware of these terms and conditions and comply with them. 

If we decide to transfer the rights and obligations for this website to someone else we will tell you, in writing, and ensure the transfer does not affect your rights under the contract. 

This website is directed at UK residents and we do not present content on or through this site appropriate for use or available in other locations. 

How you may use material on our site 

As for the intellectual property rights in our website, we are the licensee or owners of all of those rights and the material published on the site. Those works are protected by copyright laws and all such rights are reserved. 

Feel free to print off one copy or download any articles from our site for your own personal use, and you may draw the attention of others within your oganisation to the content on our website, but do not modify the print out or digital copies in any way. Neither must you use any audio sequences, photographs, illustrations or graphics separately from any accompanying text. 

You must always acknowledge our status and that of any of our contributors as the authors of the content and you must not use any of that content for commercial purposes without obtaining permission from us or our contributors. 

As much as we make every reasonable effort to make sure our content if fair and accurate at time of publication, it is provided for general information only and not intended to amount to advice on which you should rely. Content uploaded to our site 

You must comply with the content standards set out below whenever you upload content to our site or contact other users of our site. You will be liable to us for any breach of that warranty. Which means you will be responsible for any loss or damage suffered by us resulting from your breach of warranty. 

You will retain all of your ownership rights of any content you upload and any such content will be considered non-confidential and non-proprietary. You will be required to grant us and other users of this website a limited licence to store, copy and use that content and to distribute it and make it available to third parties. 

If a third-party claims that any content posted by you constitutes a violation of their rights to privacy or intellectual property rights then we have the right to disclose your identity to them. 

If in our opinion your post does not comply with the contentstandards we have the right to remove it. 

As for securing and backing up your content, that is entirely your responsibility. 

Prohibited uses 

Using our website for lawful purposes is fine. You must not use it for fraudulent or unlawful purposes, to bully, humiliate, insult or intimidate, to harm minors in any way, or in any way that breaches any applicable law or regulation - local, national or international. 

Neither must you use it to transmit or procure the sending of unsolicited or unauthorised promotional material or adverts or any other similar form of solicitation, or to send or receive, download, upload re-use or use any material which fails to comply with the standards we set for our content. 

You must not send or upload any material or transmit any data that contains viruses, worms, time-bombs, keystroke loggers, adware, spyware, harmful programs or similar computer code designed to adversely impact any computer software or hardware. 

In using the site you also agree not to damage or disrupt, interfere with or access without authority any part of our website, equipment or network on which our site is stored, any software used to provide this website or equipment, software or network used by any third party, and not to copy, resell, reproduce or duplicate any part of our site. 

Interactive services 

From time to time we may provide interactive services on our site which might include, without limitation, bulletin boards, have your say comment articles, chat rooms - where we provide an interactive service. And where we do so there will be clear information about how this service is offered and whether it is moderated and how. 

You have our word we will do what we can to assess any possible risks from third parties for anyone using any interactive service provided by our website. We will decide on a case-by-case basis whether it is appropriate to moderate that service, including the kind of moderation we will use to avoid any risks. 

Nevertheless, we are not under any obligation to monitor, moderate or oversee interactive services we might provide on this website and whether we moderate our services or not we expressly exclude our liability for any damage or loss which may arise from your use of any interactive service we offer by any user in contravention of our content standards. 

Any parent or guardian who permits a minor to use our interactive services we would advise them to make sure that child is aware of the potential risks to them of using any interactive service and aware of their need to guard their safety online, as moderation is not fool proof.  

we would normally provide you with a way of contacting the moderator should we moderate any of our interactive services, in case a difficulty or concern should arise. 

Content standards of our content 

Any or all of the material you might contribute to this website, and any interactive services associated with it, must adhere to these content standards. That applies to each part of any contribution you might make to this website. 

The Raikes Journal will determine whether or not a contribution breaches the Content Standards set out here.

Genuinely held opinion, be accurate where facts are stated and comply with the law applicable in any country from which they are posted and the law applicable in England and Wales. 

Contributions must not... 

Insult, intimidate, bully or humiliate, be obscene, hateful, offensive or inflammatory or defamatory, promote sexually explicit material, include child sexual abuse material, promote discrimination based on sex, race, religion, nationality, disability, sexual orientation, age or promote violence. Contributions must not infringe any database right or trademark of any other person, infringe any copyright, be likely to deceive any person, infringe any database right or trade mark of any other person. They must not be in contempt of court, be threatening, abuse or invade privacy, cause needless anxiety, annoyance, inconvenience, promote illegal activity, breach any legal duty to a third party, such as a duty of confidence or contractual duty, be threatening, cause annoyance, inconvenience, invade another's privacy, impersonate any other person, misrepresent your identify or affiliation with any person, be likely to upset, embarrass, alarm, harass or annoy any other person. 

Neither must any contribution give the impression it emanates from The Raikes Journal if this is not the case, contain any advertising or promote web links or any services to other sites or contain advertising. They must not contain any statements you know, have reasonable grounds for believing or believe members of the public are likely to understand to be a direct or indirect encouragement or inducement to the commission of, instigation of or preparation of acts of terrorism. 

Any contribution must not assist, promote, advocate or incite anyone to commit any unlawful or criminal act - such as computer misuse or infringement of copyright (by way of example only). 

Should you breach this policy... 

Any failure to comply with what we consider to be the acceptable use of this policy will be considered by The Raikes Journal to be a breach of these terms of use and we may take action we deem to be appropriate, should we consider a breach of these terms has occurred. 

These might include the immediate removal of your contribution from the website, immediate or temporary withdrawal if your right to use this website. We might issue a warning to you or instigate legal proceedings against you for reimbursement of all costs resulting from the breach and might take still further legal action against you. 

We would not hesitate to disclose any information to law enforcement authorities if we feel it necessary or if the law requires us to do so. And the actions we may take are not limited to what we describe above as we may also take other action we deem reasonably appropriate. We exclude our liability for all action we may take in response to any breaches of this policy. 

If you do upload any content to this website you are granting The Raikes Journal, our users, other third parties, a perpetual worldwide royalty-free, non-exclusive, transferable licence to use, distribute, reproduce, prepare, imitate works of, display, that user generated content in connection with the service provided by The Raikes Journal's website and different media and for that content to be used to promote the website and our service. 

Viruses - you must not introduce them, and neither are we responsible for them. You have responsibility for and should use your own software to protect you for viruses and you are responsible for configuring your computer programmes, information technology and platform to access our site. 

You must not knowingly introduce viruses, trojans, logic bombs, worms or any other material that might be technologically harmful or malicious. 

You must not attack our site via a denial of service attack or a distributed denial of service attack and you must not attempt to gain unauthorised access to our website or the server on which it is stored, or any computer or server or database connected to or using our website. 

The Computer Misuse Act 1990 says you will be committing a criminal offence should you break this provision and we will report you to the relevant law enforcement authorities, cooperate with those authorities and disclose your identity to them - and your right to use our website will cease immediately. 

Want to link to our website? 

Providing it is done in a way which is legal and fair you may link to our home page, provided you it does not damage our reputation or take advantage of it. But you must not link in a way which suggests any form of approval, endorsement or association on our part if none exists and you must not establish a link to our website on any website that you do not own. 

You may not, without our permission, create a link to any part of our site other than our homepage, neither must you frame it on any other site. If you do link to our website you must comply with the content standards set out in these terms, in all respects. 

On top of that, we reserve the right to withdraw your permission to link to our website without notice.

Payments
Payments should be made online unless there is a specific written agreement between the user and The Raikes Journal which allows payment in some other way.

Anyone placing adverts, articles or listings or other information to our website shall pay through Paypal™. An email will be sent automatically from Paypal™ on receipt of payment confirming the transaction has been completed successfully. A VAT invoice containing the order details will only be sent from The Raikes journal only if requested and agreed. Once the user has recieved email confirmation of payment the contract between The Raikes Journal and the user is complete.

In the case of disputes, laws from which country apply? 

Please note, if you are a consumer it is English law that governs these terms of use, their formation and subject matter. You and we agree it is the courts of England and Wales which will have exclusive jurisdiction - except if you are a resident of Northern Ireland. If that is the case you may also bring proceedings in Northern Ireland, and if you are a resident of Scotland then you can also bring proceedings in Scotland. 

Should you be a business then these terms of use, their information, subject matter and any non-contractual disputes or claims, are all governed by English law and we both agreed the courts of England and Wales have exclusive jurisdiction. 

Our trademark 

The Raikes journal is a trade mark owned by us and as a result you are not permitted to use it without our permission.
